mEYE World Photographic Competition Terms & Conditions
1 Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
Who can/cannot enter
2 Macular Degeneration Foundation employees and board directors, judges of the mEYE World Photographic Competition and Competition Secretariat employees, and each of their immediate families are not permitted to enter the competition (“Ineligible Entrants”). Immediate family means parents, siblings, partners, children and grandparents.
3 Entry to this competition (other than entry to the Junior category of this competition) is open to Australian residents who are 18 years and over, except Ineligible Entrants. For the avoidance of doubt, entry is open to employees and family members of the Macular Degeneration Foundation’s sponsors and supporters, including ODMA who otherwise meet the requirements of this clause 3.
4 Entry to the Open category is open to all entrants who meet the requirements of clause 3.
5 Entry to the Macular Degeneration Community category is restricted to people who have Macular Degeneration or any other macular disease and their family, friends and carers who are not excluded by another clause in these Terms and Conditions.
6 Entry to the Healthcare Professionals category is restricted to people who work as a healthcare professional, including optometrists, ophthalmologists, general practitioners, complementary healthcare workers, nurses, pharmacists and pharmacy assistants who are not excluded by another clause in these Terms and Conditions.
7 Entry to the Junior category of this competition is open to Australian residents who are under the age of 18 as at 14 September 2012, except Ineligible Entrants.
8 All entries in the Junior category must have permission from a parent or guardian to submit a valid entry for the competition as indicated in the entry form. Entries in the Junior category are only valid if a parent consent form is completed and submitted via email (scanned), fax or post. The parent consent form can be downloaded from the competition website www.meyephotocomp.com.au.
Timing
9 The competition commences at 11.01 EST on Thursday 14 June 2012 and closes at 23.59 EST on Friday 14 September 2012 (“Competition Period”).
Entry forms and requirements
10 To enter, individuals must complete an entry form available online at www.meyephotocomp.com.au during the Competition Period. Entries must include a photograph taken by the entrant and 30-60 words that explains how that photograph shows their appreciation of the gift of vision. There are four categories and individuals must tick the box corresponding to the category being entered on the entry form. The competition categories include: Open – general public category; Macular Degeneration category; Healthcare professional category; and Junior category. Entrants must only submit an entry in categories that they are eligible to enter, in accordance with clauses 4, 5, 6 and 7.
11 Entrants must submit the photograph as a digital JPEG file. Images must be a minimum size of 500KB and a maximum size of 4MB. The minimum resolution for all photos is 300dpi.
12 Incomplete or illegible entries will be deemed invalid.
13 Entries may not be digitally enhanced or manipulated.
14 All entries must be the original work of the author and factually accurate, to the best of the entrant’s knowledge.
15 Photographs entered in the 2011 competition are not permitted to be entered into the 2012 competition or future years and any such entry shall be deemed invalid.
Disqualification
16 The Promoter (Macular Degeneration Foundation) reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
17 The Promoter reserves the right to disqualify an entry if the content is deemed inappropriate and not in accordance with The Promoter’s values which include respect, compassion, integrity and competency.
Judging
18 A maximum of five entries per category, per person, will be accepted. Each entry must be submitted on a separate entry form, and for entries in the Junior category, a separate parent consent form must be submitted for each entry. If additional entries are submitted, only the first five entries are eligible for judging. Entries are judged individually based on their merits according to the criteria set out in clause 19, not the number of entries received. It is possible for the same person to win more than one category but it is not possible for the same photograph to win more than one category.
19 This competition is a game of skill. Chance plays no part in determining the winners. Entries will be judged by a panel of judges selected by the Macular Degeneration Foundation at the Macular Degeneration Foundation Suite 902, Level 9, 447 Kent Street, Sydney on Thursday 20 September. Judging will be based on entry’s creativity, composition, content and technique.
20 The best entry across all four categories, as determined by the judges, will win the grand finalist prize (“grand finalist”). In addition, the best entry in each category, as determined by the judges, will each receive a prize (“finalists”). The grand finalist will win the grand finalist prize and the finalist prize. The next two best entries in each category, as determined by the judges, will each win a prize (“runners up”). The judges’ decision is final and no correspondence will be entered into.
21 The grand finalist, finalists and runners up will all be notified by phone and in writing either via post or email on Monday 24 September 2012.
Pornography/inappropriate images
22 Any images submitted are subject to review and acceptance by the Macular Degeneration Foundation in its absolute discretion. All images are subject to all applicable Australian and International laws regarding, but not limited to, child pornography, child abuse, and obscene or pornographic material.
Winners and prizes
23 Grand Finalist: The Grand Finalist’s prize consists of:
• Return economy flights for two people from the nearest Australian capital city to Sydney on 6 October 2012 and returning to their nearest Australian capital city on 8 October 2012;
• Two nights’ accommodation at a four-star hotel in Sydney, for two people twin share;
• A Sydney Harbour Bridge Climb for two people on Monday 8 October 2012. This part of the prize is subject to the terms and conditions of Bridgeclimb Sydney and participation is at Bridgeclimb Sydney’s absolute discretion. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Bridgeclimb Sydney. If Grand Finalist is from the Junior category and under the age of 10 they will be unable to participate in this part of the prize.
• Celebratory lunch on Monday 8 October 2012 with promoter and invited guests.
There is one grand finalist prize to be won. Total RRP of the grand finalist prize $1,296.00
If the Grand Finalist winner is from the Junior category they must be accompanied by their parent or legal guardian. If under 10 years of age they will be ineligible for Bridgeclimb and will forfeit this element of the prize.
Whilst in Sydney between 6 and 8 October 2012, the Macular Degeneration Foundation may request the Grand Finalist to be available to participate in media activities associated with World Sight Day. The Grand Finalist may be required to sign additional consent agreements in relation to his/her participation in media activities.
24 All other ancillary costs including but not limited to: insurance, taxes (excluding GST), meals, drinks, and any and all other expenses are the sole responsibility of the grand finalist.
25 Finalist: The first place winners for each category (except the Junior category) will each receive: a $500 Wish Gift Card voucher , valid until 1 September 2013, which may be used for or towards any purchase in store or online. Wish Gift Card terms and conditions apply and must be used before expiry of 1 September 2013. All finalists will also receive a framed copy of their winning entry and a copy of the calendar that their photo appears in.
There are 3 x finalist prizes (excluding junior prize) to be won. Total RRP of the finalist prizes is $1,800.00
26 The Wish Gift Card voucher prizes are subject to the terms and conditions of the Wish Gift Card provider, Woolworths Ltd. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Woolworths Ltd or any associated store. Woolworths Ltd is not a participant in or sponsor of this promotion.
27 Woolworths Limited is the issuer of the WISH Gift Card but is not the promoter of the offer and is therefore not responsible for the prizes, products or services under the offer or the fulfilment of the offer terms. Woolworths Limited is responsible for the fulfilment of the terms and conditions of the WISH Gift Card. WISH Gift Cards are redeemable at participating stores only. 28 Junior Finalist: For the winner of the Junior category, the prize will be awarded to the winner’s parent or legal guardian. The prize for the Junior category winner is a Celestron 580GTL telescope donated by Mivision. The Junior finalist will received a framed copy of their winning entry and a copy of the calendar that their photo appears in.There is one junior finalist prize to be won. Total RRP of the junior prize is $400.
29 Runners Up: All runners up will receive a free copy of the calendar that their photo appears in valued at RRP $29.99 each.
30 If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal or greater value, subject to any written directions from a regulatory authority. The grand finalist must be available from the 6th to the 8th October 2012 to redeem the grand final prize. If the grand finalist is not able to come to Sydney at this time the Promoter is under no obligation to provide a substitute prize.
31 The total prize pool is RRP $3,856.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
Legalese
32 The judges’ decision is final and binding - no correspondence will be entered into. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (Macular Degeneration Foundation), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
33 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
34 Details from entries will be collected and used in order to process and conduct the competition (which may, for this purpose, include disclosure of such information third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities) and for promotional purposes surrounding this competition. Entry is conditional on entrants consenting to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing, publicity, research and profiling purposes, without further reference or payment to the entrant. Entrants should direct any request to access, update or correct information to the Macular Degeneration Foundation on 1800 111 709 during office hours.
Photo Ownership/Permission
35 Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. By submitting an entry to the mEYE World Photographic Competition the entrant retains ownership of the image. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use, modify and reproduce their entry for the purposes of the Promoter’s business and without the payment of any further fee or compensation, including to produce a calendar using the images. All proceeds from the sale of the calendar will go to the Macular Degeneration Foundation. The entrant acknowledges that the image entered in the competition will be used by The Promoter to support the Promoter’s endeavours to reduce the incidence and impact of Macular Degeneration in Australia. The Promoter agrees to attribute the entrant as the photographer in all instances.
36 Where the photograph entry contains people/persons that may be identifiable it is the photographers’ responsibility to ensure that appropriate consent is acquired before entering the competition.
